Bronson Woman Arrested For Animal Cruelty

On January 31, 2012 Deputy Ella Anderson arrested Brenda Kay Nordstrom for felony cruelty to animals. Nordstrom was transported to the Levy County Jail and at first appearance she received a $ 5,000 bond.

Deputy Ella Anderson responded to 609 Mashburn Drive Bronson, Fl in reference to a complaint of animal cruelty. Upon arrival Anderson noticed two dogs inside the fence and they were malnourished and emaciated. Anderson smelled an extremely foul odor that was similar to a decomposing body emitting from the residence and requested back up before entering the residence.

Upon entering the residence deputies were confronted with the most unsanitary conditions. The conditions were deplorable with three inches of animal feces on the floor, cats had mange and the animals were extremely emaciated and had other possible diseases. While clearing the house deputies could hear a noise coming from the bedroom and discovered several cats that were locked inside a bedroom. The cats were clawing at the door attempting to escape the nasty room.

Deputies cleared the interior of the residence and did not locate anyone inside the house. The conditions were so bad that CSI investigators had to dawn a biohazard suits and respirators in order to process the crime scene.

The Levy County Animal Control responded and removed five cats and two dogs from the residence. Deputies located Nordstrom at 683 Gilbert Street and she admitted to having knowledge that her animals were in the above conditions. Nordstrom admitted to owning the residence and the animals belonging to her. When questioned why she did not seek medical attention for the animals she responded that due to their conditions she knew the animals would be euthanized.

Juvenile Arrested For Stealing SKS Rifle

On January 30, 2012 a Williston home owner reported that unknown person(s) broke into his home. The subject entered the residence through a back window and upon entry stole a loaded SKS rifle. The victim's home was equipped with a home security system and the video captured a white male walking out the front door with a blanket over a long object consistent to a rifle.

The investigation revealed that School Resource Officer Sgt Max Long and Deputy Scott Stancil reviewed the video and positively identified the suspect as Brandon Cole Pickel, 17, from Williston. Sgt. Narayan was able to seize the stolen rifle and return the rifle to the owner.

A criminal history background check on Pickel shows that he is a three time convicted felon with a past of burglary and theft.

Williston Fire

On January 30, 2012 Deputy Scott Stancil responded to a house fire at 19990 NE 17 Place in Williston, Fl. Upon arrival Williston Fire Department and Levy County Fire Rescue were attempting to extinguish the fire. The homeowner, Sandra Adame stated that she was outside feeding the horses when she noticed smoke coming from her residence. Ms. Adame advised that her five-year-old son was inside the residence playing and she feared for his safety. Ms Adame and her son were not harmed and she ran down the lane and flagged a motorist to call 9-1-1.

Due to drought conditions the fire quickly spread from the house to other horse paddocks and the fire personnel were attempting to save the house and the horses. The fire was extinguished and the horses were not harmed but the mobile home was not so lucky.

At this time it is unknown the cause of the fire but the State Fire Marshall has been notified and the investigation continues.

Morriston Man Leads Deputies on a Pursuit

On January 18, 2012 the Levy County Sheriff's Office received a call that a subject driving a gray truck left the scene of a hit and run accident. The caller stated that the subject was last seen traveling west on County Road 316 and he was driving erratic.

Major Sullivan and Lt Mullins were in the area and began looking for the subject at the intersection of SR-121 and Highway 41. The subject was seen driving a gray Nissan Titan truck with front end damage from the crash and he made an illegal U-turn in front of deputies. The subject proceeded south on SR-121 from Williston and when the subject saw Sgt. Wells he made another U-turn at Williston Airport road. I activated my emergency lights in an attempt to stop him. The subject refused to pull over and sped up to speeds of 75mph with Sgt Wells directly behind the subject with his emergency lights and siren activated. The subject continued southbound on SR-121 and was weaving all over the road and we feared that the driver may possibly cause a head on collision.

The subject prior to reaching the intersection of SR-121/41 came to an abrupt stop and shot deputies a "Bird". The subject continued to reach in the seat with his right hand and he was ordered at gun point to show his hands and get out of the truck. The subject refused to exit the truck but finally reach out the driver's window and shoot us the bird with both hands. The subject is a very large man (6'02", 300lbs) and he had to be physically removed from the vehicle and he resisted arrest with violence. The subject had to be restrained with two pair of handcuffs and he was arrested for fleeing and attempting to elude a police officer and resisting arrest with violence. The Florida Highway Patrol investigated the traffic crash and there were no reports of any injuries.

The subject was later identified as Roy Thomas Willard, 62 from Morriston. Upon arriving at the jail Willard apologized to Sgt. Wells for his actions.

OPERATION ONE EYE JACK

The Levy County Sheriff's Office, Williston Police Department and the Chiefland Police Department executed a search warrant at 241 NE 11^th Street in Williston and arrested eight people. Community leaders have complained about the criminal activity at this location which is a known as the "Gambling House".

The investigation revealed that the Drug Task Force Agents made undercover drug buys in December 2011. Agents purchased marijuana and powder cocaine from Darryl James at the Gambling House. James was using the house for illegal gambling, selling and using drugs, selling alcohol and cigarettes without a license and renting the back bedroom for prostitution.

The Gambling House is known to have as many as 40-50 people on the premises on any given night and in the past have become very combative towards Williston Police Officers during a traffic stop. Agents decided that on Friday the 13^th Operation "One Eye Jack" would commence after dark and shut down the illegal business.

Upon arriving at the location the entry team was confronted with 9 people gambling and had assorted drugs (cocaine-marijuana) and cash on the table. Inside the residence James was selling alcohol, cigarettes, cigars, chips, candy, beer and condoms without a license.

Upon Agents arriving on the scene there were numerous people on foot that attempted to run and one vehicle that was parked in the front yard that attempted to escape the drag net. The occupants in the vehicle were later identified as a driver, Quinton Harris, front passenger, Daniel Joiner and in the back seat, Manuel Terrell. The driver drove the car in reverse and attempted to flee the scene. Detective Roger Bell, Detective Jay Crooms, Police Officer Justin Douglas and Major Sullivan stopped the vehicle and the subjects were taken out of the car at gun point. Inside the car was a pistol and Daniel Joiner had 30 individually packaged baggies of cocaine and 2 bags of marijuana in his pocket.

Operation One Eye Jack netted a total of eight people being arrested and seized drugs, money and guns. The Sheriff's Office will continue to monitor this location and we have a zero tolerance for illegal activity.

Raymond Shiver

On January 11, 2012 Deputy Scott Stancil arrested Raymond Shiver for grand theft and resisting arrest without violence. Deputy Stancil attempted to stop a blue S-10 truck in the Williston area. Deputy Stancil had knowledge that Shiver is associated with the above truck and he stopped the truck for a traffic infraction.

Upon stopping the truck the passenger, Raymond Shiver jumped out and ran on foot and refused to stop. Deputy Stancil chased Shiver on foot and he was apprehended approximately ¼ of a mile in the woods.

Raymond Shiver and his brother Alexander Shiver stole a 3.5 ton air conditioner from a residence. Alexander Shiver was arrested within days of the report and Raymond went on the run. Yesterday, Raymond Shiver's luck ended when he was stopped and arrested for the above charges. Raymond Shiver was transported to the Levy County jail and he has a $ 60,000 bond.

Home Invasion Robbery

On Saturday, January 7, 2012 Investigator Roger Bell arrested Christopher Pate, Jeovany Ortiz, Janiel Perez and Armando Perez for armed home invasion robbery, felony battery and aggravated assault.

Sheriff's deputies and Investigators responded to a Bronson home in reference to a 9-1-1 call reporting a home invasion robbery. The four suspects met earlier in the night and talked about hitting a lick "Robbery". The plan was for Pate to lure the victim outside of his home and the three other suspects would commit the robbery. The plan did not go as planned when the victim refused to go outside, but he allowed Pate to enter his home. Upon entry Pate and the victim spoke about smoking a blunt (Marijuana Joint) and allegedly Pate was going to buy crack cocaine from the victim.

While Pate was inside the house negotiating the drug deal, Jeovany Ortiz and Armando Perez stormed the house wearing a mask and armed with a pistol and baseball bat and demanded money. Pate pulled a realistic toy gun concealed in his waist band and also threatened the victim. The victim stated that he was in fear of his life and his family's (mother, step father and two children ages three (3) and seven (7) year old) and he began fighting with the three suspects attempting to wrestle the guns and baseball bat from them. The suspect's pistol whipped and struck the victim in the head with the baseball bat and fled the house on foot.

While fleeing from the scene Jeovany Ortiz turned around and fired at the victim and missed him by only inches. During this incident the step father woke up and fired two rounds from his shotgun in the air in an attempt to scare the suspects from returning to the house.

The victim sustained a head laceration and was transported to a local hospital.

Sullivan said "I'm very proud of the Deputies, Investigators and dispatchers in handling this incident and the team work to have these bad guys in jail less than 24 hours".

ATV Safety

Bronson, Florida-The Levy County Sheriff's Office has seen an increase in All Terrain Vehicle Accidents. Over this past weekend there were two tragic ATV accidents resulting in fatalities. I would like to inform you of the laws pertaining to ATV's and give you some safety tips to prevent you from being a victim of an ATV accident.

You may also go on-line to www.ATVSafety.gov for additional safety information.

In 2006 the Florida Legislature passed a law allowing ATV's to be operated on any public roads or streets during the daytime hours on an unpaved roadway where the posted speed limit is less than 35 miles per hour by a licensed driver. The Levy County Commissioners on October 17, 2006 passed County Ordinance 90-3 stating it is unlawful to operate an ATV on any roadway, paved or unpaved streets in Levy County. In Levy County there are several locations to legally ride and have good quality family time when riding your ATV.

Under Florida State Statue 316.2074 (3) it is unlawful for any person 16 years of age or under to operate or be a passenger on an ATV without a helmet and safety goggles. No person shall be a passenger on an ATV that is not designed or equipped for said person.

ATV Safety Tips:

Wear a helmet & eye protection at all times.
Do not carry passengers on an ATV.
Do not let young or inexperienced riders operate ATVs without training & supervision.
Do not use alcohol or other drugs when riding.
Always maintain a safe distance between riders.
Always let someone know where you are riding.
Never ride alone.
Always ride at a safe and responsible speed. Know your abilities and don't exceed those levels.
Make sure the ATV is in safe working condition.

Morriston Man Caught on Camera

The victim, Roy Alexander reported to the Sheriff's Office that someone stole his 3.5 ton air conditioner from his Williston home. This is the second time someone has stole the victim's air conditioner. The victim stated that he concealed a game camera facing the A/C unit and obtained photographs of the suspects stealing the A/C.

On December 27, 2011, the victim reported that unknown person(s) stole his A/C unit and he has photographs of the suspects and their vehicle and the suspects loading the A/C unit in a Ford truck. On January 2, 2012 a concerned citizen notified the Sheriff's Office and stated that the truck used in the theft may belong to Raymond Shelton Shiver from Morriston. Deputy Scott Stancil and Sgt. Mike Narayan went to the suspect's residence located at 4350 SE 138^th Terrace and made contact with Raymond Shiver's son, Alexander Matthew Shiver. Deputies were able to identify Alexander Shiver as one of the two suspects in the theft. The second suspect has been identified as Raymond Shiver, Jr., which is Alexander's older brother.

Alexander Shiver was arrested for grand theft and he is on felony probation for grand theft. Deputies are currently looking for Raymond Shiver, Jr. and if anyone knows his whereabouts is asked to call the Levy County Sheriff's Office.

Michael Douglas Arrested For Theft

The victim, Rex Vance reported that unknown person(s) stole his Franklin logging skidder valued at $7,500. The victim had the skidder parked at the Wolf Springs Hill area in Bronson. During the investigation Investigators developed a suspect, Michael Douglas. Douglas stated that he purchased the skidder from Andrew Brown on December 11, 2011. Investigators were able to track down Andrew Brown and he advised that he didn't sell a skidder to Douglas and he has not seen him in several years.

Douglas was re-interviewed and he advised on December 18, 2011 he used his Ford F-350 truck, flatbed trailer and his loader to remove the skidder. Douglas transported the stolen skidder to his residence and cut the skidder up for scrap metal. Douglas contacted Glenn Perry to assist him in cutting the skidder and told him that he would give him 1/3 of the profit if he took the steel to Ocala scrap yard. After speaking to Perry he did not know the skidder was stolen and he took the cut up skidder to Williston Recycling. Employees at Williston Recycling advised Perry that the police were looking for a lime green skidder and Perry got scared and called Douglas to pick up the stolen skidder.

The victim positively identified his skidder. Douglas was arrested for grand theft and dealing in stolen property and he was transported to the Levy County Jail. Investigators seized Douglas' truck, flatbed trailer and loader since his equipment was used in a felony crime.

Williston Man Barricaded With A Gun

Deputies responded to a Williston residence in reference to a man with a gun. Upon arrival the adult male was armed with a pump .22 rifle and barricaded inside his home. Deputies spoke to the distraught man and he explained that he was depressed because he did not have a job, no money and tired of having no food.

After a two-hour stand off deputies were able to negotiate him out of the residence. The Williston man was baker acted and was transported to Gainesville to Crisis Stabilization Unit (CSU), which helps patients with mental health issues.

Chiefland Man Threatens to Burn House & Shoots Family Dog

On December 22, 2011 the Levy County Sheriff's Office responded to 7290 NW 95^TH Street Chiefland in reference to a domestic altercation. The complainant stated that her husband, Arthur Pipes Jr. left prior to deputies' arrival armed with several weapons including an AK-47 assault rifle. The complainant stated that Pipes made threats that he would shoot law enforcement or wanted the police to shoot him. A statewide BOLO (Be On The Lookout) for Pipes was issued for Officer safety.

The complainant stated that the altercation began Thursday night at a Chiefland Pool Hall and continued when they got home. The victim advised she was scared of her husband and stayed at her mother's residence. Pipes is a veteran serving in the Army & completed two combat tours in Iraq. The victim advised that Pipes has been diagnosed by the V.A. Hospital with Post Traumatic Stress Disorder (PTSD) and had been out of his medication for over 6 days.

On December 23, 2011 the victim called 9-1-1 and reported that her husband was at the residence. Upon deputies arrival Pipes had left the house and a bolo was issued. The investigation revealed that Pipes became extremely angry when the victim told him she wanted a divorce and emptied the bank account. Pipes went outside and armed with a 5-gallon gas can started dousing gas throughout the house. Pipes had a cigarette lighter and attempted to light the house on fire when the victim and her mother wrestled the lighter from his hands. Pipes walked outside and shot the pet dog (Mix Labrador) several times with an AK-47 killing the dog and then he fled the scene in a black Ford truck.

During the investigation at the residence Pipes returned and deputies ordered him out of the truck. There was a short stand off, but Pipes complied with their orders and he was arrested for two counts of aggravated assault, one count of animal cruelty and one count of attempted arson. Inside of Pipes truck deputies found a loaded AK-47 rifle, loaded 380 semi-automatic pistol, .22-caliber rifle in the toolbox and two flashlights.

Pipes gave Sgt. Mike Narayan a statement and admitted to pouring gasoline with intention to burning the house. Pipes said he risked his life fighting in Iraq and earned money to pay for the house and now his wife has emptied the bank account and wanted a divorce. Pipes stated that he shot the victim's dog three times with his AK-47 because the dog would not stop barking.

Pipes is currently in the Levy County Jail with a $ 600,000 bond.

Drug Dealer Arrested by Task Force

On December 16, 2011 the North Florida Violent Fugitive Task Force comprised of the US Marshals Service, Levy County Sheriff's Office, Alachua County Sheriff's Office and the Gainesville Police Department arrested Kenyatta Daron Howard.

The Levy County Sheriff's Office Drug Task Force made undercover drug buys from Howard and obtained an arrest warrant for sale and possession with intent to distribute cocaine. Howard was considered as a mid level drug dealer in Levy County supplying drugs to the Cedar Key and Chiefland areas. The man hunt ended today when the Fugitive Task Force through hard work and good old fashion police work located Howard at the American Best Value Inn motel in Gainesville. Upon Deputies approaching the motel, Howard ran on foot and he was tackled and placed under arrest. Howard was transported to the Alachua County Jail and has a $ 325,000 bond.

Howard is also a registered sexual offender in Levy County. Howard was convicted in 1999 for lewd & lascivious behavior with a child.

Chiefland Man Arrested on Drug Charges

On December 12, 2011 the Levy County Sheriff's Office Drug Task Force comprised of Agents with the Chiefland Police Department and the Sheriff's Office arrested Torry F. White. Agents utilized a confidential source to conduct a control purchase of narcotics. The confidential source was issued $ 120.00 of US Currency to buy pills from Torry White also known as "Big White". Big White sold 25 pink pills that were later identified through the 2012 Narcotic Identification Bible as Lortab. Lortab is subscribed by physicians for pain management.

Upon the illegal drug transaction "Big White" drove away in his 2001 Chevrolet with Florida tag 232-LNV westbound on County Road 345 and was stopped by Agents at NW 55 Ave. Agents immediately arrested "Big White" and recovered the Sheriff's buy money. "Big White" was arrested for trafficking in Lortab and the total weight was 21.5 grams. Per Florida State Statues anything over 4.0 grams is considered to be a trafficking amount of pills. Chiefland Drug Raid

The Levy County Sheriff's Office and Chiefland Police Department executed a search warrant at 10091 NW 40^th Ave in Chiefland, Fl. Undercover Agents received numerous complaints from the community that there was an unusual amount of vehicle traffic driving to the residence. The drug house is located directly across the street from the ST. John Evangelist Catholic Church.

Agents initiated an investigation and confirmed the vehicle traffic and made undercover drug buys from Christopher Eugene McQuay. The below listed subjects also lived at the residence and had knowledge of the drugs deals. During the investigation Agents received information that there were guns inside the residence and there were threats to shoot law enforcement.

Drug Task Force Agents executed the drug search warrant on Friday, December 2, 2011 in the early morning hours. Upon entry in the residence there were five (5) adults and three children. The four adults were arrested and a relative was called to pick up the children where they could attend school. Agents have notified Department of Children & Families due to the fact there was a 10, 12 and 15-year-old living at the residence. During the raid Agents seized crack cocaine, marijuana, firearms, bullets and over $8,500 in cash.

Armed Sexual Battery Arrest

On November 11, 2011 the Levy County Sheriff's Office received a complaint in reference to a sexual assault. The allegation involved Zachary Knight a Lieutenant with the Levy County Sheriff's Office. Upon being advised of the complaint the Florida Department of Law Enforcement was immediately contacted.

FDLE assumed command of the investigation and interviewed the victim and witnesses. Late this evening a search warrant was executed at a Levy County residence by FDLE & the Levy County Sheriff's Office.

FDLE obtained an arrest warrant for Knight and he was arrested at a Chiefland residence. Knight has been charged with armed sexual battery, false imprisonment, and aggravated assault and tampering with a victim. Knight has a $ 2,050,000 bond.

Knight has been suspended without pay.

Plane Crash at Wing Field Airstrip Follow Up

The Levy County Sheriff's Office on November 5, 2011 responded to a fixed wing single engine airplane crash in the Morriston area that resulted in two fatalities. A witness with over 50 years as a pilot advised that the aircraft taxied down the Wing Field private air strip shortly after 4:30 pm. The witness stated as soon as the airplane took off he heard the airplane spit & sputter and then watched it crash into a heavily wooded area just north of the air strip.

The investigation revealed the aircraft was a 1956 Beech Craft T-34. The aircraft was registered to Ralph Ken Terry from Daytona Beach, Florida. The deceased were identified as passenger Ralph Terry and pilot Mike Fuller from Port Orange, Florida. Mr. Terry was retired from Northwest Airlines with approximately 30 years of service and over 60 thousand hours of flight time. Mr. Fuller was a manager at Yelvington Aviation.

On November 6, 2001 the Levy County Sheriff's Office transferred the investigation to the Federal Aviation Administration and the National Transportation Safety Board.

Plane Crash in Morriston

The Levy County Sheriff's Office is investigating a fixed wing single engine airplane crash in the Morriston area that resulted in two fatalities. A witness with over 50 years as a pilot advised that the aircraft left the private air strip called "Wing Field" shortly after 4:30 pm. Sheriff’s Drug Task Force Arrested 5 in Drug Raid

Sheriff's Drug Task Force Arrested 5 in Drug Raid

The Levy County Sheriff's Office and the Chiefland Police Department executed three drug search warrants simultaneously in the Chiefland area. The operation began shortly after dark last night and five people were arrested on various charges. The charges range from obstruction of justice to a variety of drug charges.

Arrested was James Tarnellius Clemons at 725 S.E. 1 Street, Chiefland. Upon arrival, Agents located Clemons outside in the front yard cooking oysters. Clemons obstructed officers and resisted arrest without violence. Upon the search warrant being executed at his residence agents seized 81.7 grams of marijuana, 6.9 grams of crack cocaine, 5.2 grams of powder cocaine, cutting agents to manufacture his drug operation, straws, baggies, scales and a large amount of US Currency.

In the second search warrant, agents arrested Craig Joshua, 28 years of age, from Chiefland. The search warrant at 8871 NW 55^th Ave. stemmed from a series of investigations that involved the purchase of drugs from Joshua. During the raid, the agents seized 57 pieces of rock crack cocaine, 3.5 grams of marijuana and US currency. Joshua also had outstanding Levy County warrants for the undercover buys. While agents were at Joshua's residence, Rollie Tillery pulled up in the driveway. Lt, Ray Tremblay, with Chiefland Police Department, observed Tillery fumbling and attempting to hide something in the car. A search revealed that Tillery hid crack cocaine in the back seat and he was arrested for possession of crack cocaine and resisting arrest without violence.

The third search warrant was executed at 13559 NW 65^th Terrace in Chiefland. Drug Task Force arrested Jessie Bryan Balogh for trafficking in cocaine, possession oxycodone with intent to distribute and numerous other felony drug charges. Agents seized 35.4 grams of cocaine, oxycodone pills and 52.2 grams of marijuana. While agents were executing the warrant, Kelvin Thompson pulled up to the residence and he was arrested for felony driving while license suspended and possession of marijuana (29.2 grams). When Thompson saw the agents, he immediately threw a bag of marijuana which was later located and seized.

The raids were executed simultaneously due to the understanding the drug dealers were believed to be associated and the operation could have put the Deputies in harms way. The street value of the narcotics seized was approximately $10,000 and agents recovered over $4,000 in cash. The Chiefland drug operation resulted in 15 felony arrest and 13 misdemeanor arrests. We are very proud of our Drug Task Force in their efforts to fight the war on drugs.

Drivers beware: local law enforcement across the region will be cracking down on drunk drivers with an aggressive Drive Sober or Get Pulled Over enforcement blitz. “There isn’t a Halloween costume clever enough to hide a drunk driver who’s made the dangerous decision to get behind the wheel,” Sheriff Smith “Law enforcement officers are committed to keeping the roads safe for everyone to enjoy the holiday.” Nighttime is always a dangerous time on the road. But Halloween is one of the deadliest nights of the year for impaired drivers. According to the National Highway Traffic Safety Administration, 48 percent of all highway fatalities throughout the nation on Halloween night (6 p.m. Oct. 31 to 5:59 a.m. Nov. 1) in 2009 involved a driver or a motorcycle rider with a blood alcohol concentration of .08 grams per deciliter or higher, which is illegal in every state. “The scariest parts of Halloween aren’t the spooky costumes and scary pranks,” said Sheriff Smith. “It’s the fact that too often impaired drivers don’t plan ahead and end up making the roads scarier than a horror show.”

Employee Reaches Million Dollar Mark.

The Levy County Sheriff’s office would like to take this opportunity to recognize one of its own in a milestone achievement of financial relief to the Citizens of Levy County in these tough economic times. The E911 system is funded with a $.50 per month fee collected on telephone lines. With the advent of cell phones many people have chosen to drop their landline phones reducing revenue to support E911. However, due to Florida’s Rural Grant Program for E911 counties with a population under 75,000 can receive funding for projects unattainable with only the monthly revenues.
Today we honor Christine Sheppard, the Database Manager of The Levy County E911 department. Due to Christine’s hard work the citizens of Levy County now have a modern, cutting edge, state of the art 911 call center and VoIP (Voice over the internet protocol) delivery system that saves our office thousands of dollars monthly over the previous system. Grants have also provided for mapping the entire county with road centerlines and GPS points for addresses and cell tower sites. All of these technology upgrades were done without cost to the tax payers of Levy County by the over 1 Million dollars of grant funding awarded to our office through Christine’s hard work and dedication over the last few years. Christine’s actions reflect great credit on herself, the Sheriff’s Office and the Public Safety Community as a whole.

Update to July 4, article "Thieves arrested During Stake out"

On July 1, 2011 the Levy County Sheriff's Office conducted a stake-out on some farm equipment that had been reported stolen by Mr. Freddie Bell of Williston. The property was found at another location and appeared to be poised to use in some additional criminal activity.

With this in mind Captain Scott Anderson and Lt. Duane Dyskstra of the Levy County Sheriff's Office conducted surveillance on the equipment. The criminals did indeed return to the scene of the crime and were subsequently arrested. One of those arrested were Fredrick Arthur Mills Jr. w/m dob 8/2/76. Mills was convicted and sentenced to 15 years on October 5, 2011 in Bronson FL on 5 felonies and 2 misdemeanors. The second defendant involved in this case Wayne Joseph Drake w/m dob 6/22/66 is till awaiting trial.

Robbery at Tackle Box Fanning Springs

On Saturday, September 17, 2011 the clerk at the Tackle Box in Fanning Springs reported a robbery. The clerk stated that he locked the front door to handle business in the back and he heard someone attempting to open the door. The clerk went to the front door and let the white male in since the store was open for business. The suspect followed the clerk behind the counter and stated that he needed cigarettes. The clerk told him to remain on the opposite side of the counter. The suspect pushed the clerk and had his right hand under his shirt as if he had a weapon. The suspect had the clerk open the register and the suspect removed an undetermined amount of cash.

The suspect is described as a white male, approximately 5'07", 140-150 lbs, with short reddish to light color hair and clean shaven. He was wearing a sleeveless white shirt and plaid white & black shorts. The suspect left north on Us Hwy 19 in a white extended cab pickup truck.

Deputy Drew was minutes from the robbery and searched for the suspect in Dixie County to no avail. Anyone who has information on this incident is asked to call Investigator Mike Bell at 352-486-5111.

Murder Suspect Arrested After High Speed Chase

On September 14, 2011 a state wide bolo (Be on Look Out) was issued for a murder suspect possibly driving a green Ford Explorer from Riviera Beach, Fl. Shortly after 5 Pm the Ocala Police Department located the suspect's vehicle and attempted to conduct a felony traffic stop. The driver refused to comply and a high speed chase ensued through the city of Ocala. The driver continued to elude officers and went northbound on Hwy 27 through Fellowship and Blitchton. Ocala Police Department notified the Levy County Sheriff's Office that they were going to enter Levy County and the suspect was considered armed and dangerous.

Major Evan Sullivan took over the pursuit at the Levy/Marion County line and the chase continued through the city of Williston. Sgt Wilbur Wells with Levy County Sheriff's Office set up stop sticks at Olive Drive & Hwy 27 and was successful in deflating the tires on the suspect's vehicle. The suspect continued northbound and his front/rear tires on the passenger side exploded. Refusing to stop, the suspect lost control and veered off the road in the area of Cr-102 & Hwy 27 striking several trees before coming to a rest on the passenger side.

The driver was transported to a local hospital where he is in stable condition. The driver of the Explorer was identified as the murder suspect, Robert Lee Benjamin, 55 years of age, from Riviera Beach, Fl.

On Friday, September 2, 2011, the Levy County Sheriff’s Office, together with Inglis and Chiefland Police Departments with equipment borrowed from the City of Williston, conducted a DUI Checkpoint in Inglis as part of the National "Drive Sober or Get Pulled Over” Campaign. This campaign was to reduce and eliminate impaired driving on our roadways. During this 3-hour road block they stopped 73 vehicles and issued 13 total citations with one being for open container. Although no DUI arrests were made, this collaborative agency approach to DUI enforcement will be the first of many for 2011. This team approach makes cost effective impaired driving enforcement a reality in these tough economic times. Sister Shoots Sister Out Of Anger

On September 1, 2011 deputies responded to 555 East Thrasher Drive in Bronson in reference to a domestic argument. Upon arrival deputies and Investigators made contact with the victim and discovered that she had a gunshot wound to the foot.

The investigation revealed that Dorlinda Gilham got into an argument with her sister over health care issues for Gilam's grandson. Gilam became extremely angered during the argument and retrieved a small caliber pistol and shot her sister in the foot. The victim was treated and released at a local hospital.

During an interview with Gilam she stated that she had been arguing with her sister for the past two days. Gilam stated that she retrieved the weapon in fit of anger and fired the gun to scare her sister. According to Gilam she shot in front of her sister and the bullet ricocheted and struck her sister's foot. The bullet was recovered in the victim's shoe.

Gilam was arrested for aggravated domestic battery and transported to the Levy County Jail.

Bronson,Fl– Levy County Sheriffs Office today announced it will join nearly 10,000 other law enforcement agencies nationwide in support of an intensive crackdown on impaired driving August 19–September 5, known as “Drive Sober or get pulled Over.” The problem of impaired driving is a serious one. Data from the National Highway Traffic Safety Administration shows the number of alcohol-impaired-driving fatalities in America fell from 2008 to 2009, but the numbers are still too high. In 2009 alone, 10,839 people died in crashes in which a driver or motorcycle rider was at or above the legal limit, according to the National Highway Traffic Safety Administration. The age group with the highest percentage of alcohol-impaired-driving fatalities in motor vehicle traffic crashes was the 21-to-24 age group. “All too often, innocent, law-abiding people suffer tragic consequences and the loss of loved ones due to this careless disregard for human life. Because we’re committed to ending the carnage, we’re intensifying enforcement during the crackdown. The crackdown will include law enforcement officers in every state, Washington, D.C., and many U.S. cities and towns. Levy county Sheriffs Office said its deputies will be aggressively looking for all impaired drivers during the crackdown and will arrest anyone they find driving while impaired — regardless of age, vehicle type or time of day. “Our message is simple and unwavering: if we find you driving impaired, we will arrest you. No exceptions,” said Major Evan Sullivan. Even if you beat the odds and manage to walk away from an impaired-driving crash alive, the trauma and financial costs of a crash or an arrest for driving while impaired can still destroy your life.” According to the Levy County Sheriffs violators often face jail time, loss of their driver licenses, or being sentenced to use ignition interlocks. It seems hard to believe that another summer has come and gone and it's time to start getting the kids ready to go back to school. On August 22^nd Levy County will begin that timeless annual ritual: the first day of school. It is a time when parents breathe a sigh of relief and students and teachers anticipate new beginnings and new challenges.

Unfortunately, the beginning of school is also a time when children are at increased risk of transportation-related injuries from pedestrian, bicycle, school bus and motor vehicle crashes. This happens because there are more children on the road each morning and afternoon which may cause driving patterns to change. So as schools open their doors, it's time for everyone—motorists, parents, educators and students—to improve their traffic safety practices.

The familiar yellow school bus has become one of the most powerful icons in American society. Day-in and day-out, the nation's 418,000 yellow buses travel more than 4.5 billion miles a year at a cost of nearly $10 billion. They safely carry 24 million children-nearly half of all the nation's children-to and from school.

While school buses can be proud of their safety record, there are still aspects of school bus transportation that are dangerous to children. More children are hurt outside a bus than inside one. Getting on and off the bus is the most dangerous part of the bus ride. This loading and unloading area is called the "danger zone." This area extends 10 feet in front of the bus, 10 feet on each side of the bus and 10 feet behind the bus. The danger zone is where children are at greatest risk of not being seen by the bus driver. The child who bends over to retrieve a dropped school paper, or who walks too close to the bus while crossing the street, is at greatest risk of becoming the next statistic in this danger zone.

Parents and other adults must also do their part. For instance, most motorist need to learn to share the road with school buses. They must stop when the bus stops to take on or let off passengers. If we all do our part—if motorists heed school bus warning lights, bus drivers drive defensively, parents help their children learn to ride safely and children learn to avoid the bus's danger zone---we can increase the safety of the yellow bus ride to and from school.

Safety precaution education is the best way to keep your child safe this school year. Get involved and get your children involved. The more you know the safer your children are.

Please be careful during your travels and the Sheriff's Office will once again be conducting a program called "Operation Safe School". This program is to ensure the safety of the kids. The School Resource Officers, Volunteer Citizens on Patrol (COPS) and the Sheriff's Executive Staff will be monitoring the school zones and school bus stops for traffic violations in marked and unmarked cars. There will be a deputy assigned to each school for the first three days. The purpose is to welcome the students and parents at the drop off line and ensure there are no traffic issues at the schools.

$50,000 Caterpillar Stolen From The Road Department

On June 23, 2010 Bruce Greenlee the supervisor of the Levy County Road Department reported that unknown person(s) stole a Caterpillar back hoe valued at $ 50,000. The Caterpillar was parked at NE 155Ave and US Highway 27. Investigators followed the tracks a short distance and the tracks disappeared.

Through a lengthy investigation Sgt. Mike Narayan located the Caterpillar in the woods in the area of 7800 NE 131^st Terrace. Leads were developed and Mitchell Randall Osborn was arrested on March 7, 2011. Osborn, 32 years of age from Trenton confessed that he and Oakley Levi Hatten, 29 years of age, from Morriston stole the back hoe. The two attempted to load the back hoe on a trailer and abandoned the Caterpillar in the woods in North / South Estates. Osborn stated that Hatten gave him five oxycodone pills for his participation in the theft. Osborn stated that he is addicted to pain killers and he is receiving help for his addiction.

On July 28, 2011, Hatten was arrested for grand theft. Hatten stated that he was paid $300.00 dollars for stealing and driving the back hoe by the third suspect. The third suspect has not been arrested at this time and a warrant for his arrest is forthcoming.

The back hoe had no damage and it was returned back to the Levy County Road Department.

Naked New Port Richey Man Arrested For DUI

On August 2, 2011 Deputy Britton Drew responded to the area of Usher Tower on US Highway 19 in reference to a reckless driver. The Sheriff's Office received a complaint that a dark in color Dodge was driving north in the southbound lane on Highway 19. Deputy Drew located the Dodge Intrepid with a North Dakota tag in the Rosewood area off State Road 24.

Deputy Drew observed the vehicle on the shoulder of the road and noticed that the driver would not get out of the vehicle. The driver continued to act suspicious and refused to show his hands. The driver was later identified as Kelly Michael Bachmeier and he was completely nude. Drew requested back up due to Bachmeier's behavior, demeanor and refusing a lawful order.

Upon back up arriving Bachmeier was again ordered numerous times to show his hands and exit the vehicle and he refused. Deputies were forced to shoot Bachmeier with a taser because he would not show his hands and it was unknown if the suspect had a weapon.

Bachmeier was arrested for driving under the influence and an expired North Dakota driver's license. Bachmeier blew more than four times the legal limit (.334 and .315) on the intoxilyzer. Bachmeier was transported to the Tri County Hospital and had a blood alcohol limit of .390.

In 2010 the Levy County Sheriff's Office Citizens on Patrol (COP) Program has worked 8,649 hours with the Sheriff's Office. This Unit is a volunteer Unit within the Sheriff's Office that has saved the taxpayers thousands of dollars. The COP Unit assists with the following services:

Marijuana Cultivation Arrest Worth Quarter Million

On July 20, 2011 the Levy County Sheriff's Office Drug Task Force in conjunction with the Army National Guard conducted an aerial search in effort to locate illegal marijuana grows.

In the area of S.E. 25 Street off of Hwy 121 numerous marijuana plants were located by Captain Danny Riffle with Levy County Sheriff's Office. Captain Riffle has been spotting marijuana plants since 1983 and has seized millions dollars worth of drugs. Deputies on the ground responded to the area and confiscated 247 marijuana plants. Contact was made with the homeowner, Mark O'Leary who consented to a search of his residence. Inside the residence there were additional marijuana plants, a rifle and a small indoor growing operation.

O'Leary has been arrested four times for cultivation in marijuana in 1971-1984-2004 and 2011.

O'Leary was arrested for Cultivation of Marijuana and transported to the Levy County Jail.

Thieves Arrested During Stakeout

Media Release

On July 1, 2011 Mr. Freddie Bell reported a John Deere model 5410 tractor and mower valued at $ 15,500 missing from his property. This is the third theft at the old Bongers Dairy farm located at 12550 SE 30^th Street in Morriston, Florida. The property is over 1400 acres and is used for commercial horticulture, with planted peanuts.

The suspect(s) unlawfully entered the property during the early morning hours of July 1^st and stole the tractor/mower out of the barn. The suspects stole the tractor for the purpose of pulling copper wire from the irrigation pump and also entered another barn and stole some copper wire. The suspect(s) concealed the tractor in the woods and it appeared that they would return the following night to finish the job.

Special Operations Captain Scott Anderson and Lt. Duane Dykstra conducted a stakeout the following evening. Shortly after 4 O'clock in the morning the suspects returned to the property and went directly to the tractor. The stakeout team allowed the suspects to remove the tractor and drive across the peanut field and went directly to the irrigation pump next to the barn. The suspects had no idea that deputies were following them through the field. The suspects were in the process of stealing more copper wire and they were surprised when Anderson/Dykstra apprehended them at gun point.

The suspects were identified as Frederick Arthur Mills from Dunnellon and Wayne Joseph Drake from Inglis. Mills was charged with 2 counts of burglary, grand theft, criminal mischief, 2 counts of felony trespassing and petit theft. Mills has a $ 575,000 bond and he has a Citrus County warrant for violation of probation for drug paraphernalia. Drake was charged with criminal mischief and felony trespassing and he has a $ 5,000 bond.

This has been a growing trend with suspects stealing copper wire from irrigation pivots. The Sheriff's Office will continue our proactive stance against farm theft and use every means to arrest the subjects.

Joyner a long time Levy Countian has worked in all areas of law enforcement from patrol work, known state wide as an expert in undercover drug investigations and retiring as Chief Deputy in Jefferson County. Joyner is currently assigned to the Civil Division as a Bailiff protecting Honorable Judge Glant in addition to being an Agriculture Investigator.

Joyner will continue on a part time basis to be a Bailiff for Honorable Judge Glant.

Effective July 5, 2011 Deputy Grant Sandlin a School Resource Deputy will be assigned this summer on a full time basic to work as an Agriculture Investigator. Deputy Sandlin will educate the farmers on how to protect their farm equipment and investigate all farm crimes.

Andy Meeks Jr. Arrested

On April 7, 2011 the Levy County Sheriff's Office Drug Task Force arrested Larry Meeks Jr. for 2 counts of sale with intent to distribute and 2 counts of possession with intent to sale prescription pills (Oxycodone).

During the search warrant Meeks stated that the only thing in the house is "Juice" which is a street name for steroids. Agents confiscated four (4) vials of clear liquid and a syringe from the residence and the unknown substance was sent to FDLE laboratory.

On June 28, 2011 the Sheriff's Office received the results from the laboratory which was positive for anabolic steroids (Trenbolone Enanthate) a schedule III controlled substance.

Meeks was arrested on June 28, 2011 for possession of controlled substance.

The Board of County Commissioners of Levy County has declared an emergency declaration regarding open burning (Burn Ban). The emergency declaration number 2011-28, dated 14^th day of June 2011 declared a state of local emergency for the forest and brush fires currently burning in Levy County.

Commissioners understand that the extreme drought situation in Levy County causes an increased potential for brush fires. Extreme fires conditions can create a serious threat to the public health, safety & welfare.

The County Coordinator is appointed as the Coordinating Officer in relation to this state of emergency and is authorized to take all action necessary to secure resources to protect human life and property.

The Board has issued an emergency order for all of the unincorporated areas of Levy County prohibiting all of the following actions:

Open Burning (except outdoor grill for food preparation)

Sale, Use or Discharge of explosive or combustible compounds which include Fireworks and Flares

Parking vehicles with catalytic converters in high grassy areas

Throwing matches or cigarettes from vehicles

A violation of a duly promulgated emergency order is a second degree misdemeanor punishable by a fine up to $500.00 for each offense and by imprisonment up to sixty (60) days in jail for each offense.

Teen Driver Improvement Program

Program Funded by a Highway Safety Grant through FDOT

The Levy County Sheriff's Office, Community Relations Division, is offering a no cost, Teen Driver Improvement Program to all Levy County students who have a current Operators License or Learners Permit or who are about to get their Learners Permit.

The goal of this program is to educate the teen drivers of Levy County of the dangers of aggressive driving, distracted driving, impaired driving, and to reinforce the benefits of seat belt use. These four issues have been found to be major causes of teen involved crashes, injuries and fatalities. This program is free of cost and is 4 hours in duration. This program consists of classroom instruction, videos, power point presentations and hands on time during which the students will drive golf carts through a course to learn first hand the dangers of the choices that they make while driving. This is a graphic presentation that will show the students the human consequences of their driving choices.

Parent waivers are required due to the graphic nature of the presentation. All students will be required to pre-register for the class by calling Lt. Sean Mullins or Sgt. Max Long at 352-486-5111 ext 278 or via e-mail at smullins@levyso.com or mlong@levyso.com. A minimum of ten students are required for class to be held therefore these dates are tentative.

Cross City Man Arrested at Fanning Springs Bar

On June 9, 2011, Deputies responded to the Dawg House Bar in Fanning Springs. Upon arrival they were advised that a white male groped female patrons inside the bar. The subject was told to leave the bar and he went outside and caused a disturbance in the parking lot.

The subject was later identified as, James Leslie Cassidy a 24 year Correction Officer with the Cross City Department of Corrections. The subject was asked to calm down several times but he refused the order. Cassidy was placed under arrest for disorderly intoxication and he was placed in the patrol car. The investigation revealed that Cassidy had been drinking moonshine and was extremely intoxicated. Cassidy after being kicked out of the bar slashed six (6) vehicle tires causing over $2,750 dollars in damage.

Cassidy was arrested for disorderly intoxication, two counts of battery, seven counts of criminal mischief and threat to a public servant. While the Deputies were investigating the criminal mischief the battery victims advised that Cassidy had groped them inside the bar by putting his hands down their pants.

While enroute to the jail Cassidy threatened to stab the deputy when he gets out of jail and also threatened to kill the deputy's family. Cassidy became very irate and started kicking the cage in the patrol car causing over

$100.00 in damage. Upon arrival at the jail Cassidy had to be physically restrained in a special restraint chair due to his violent behavior.

Williston Fire Rescue would like to update you on the Badland Fire in the Goethe State Forest. The fire service has set up an Incident Command post located at the Division of Forestry headquarters on CR 337 just south of SR 121. Our Fire Departments are working closely with the Division of Forestry in efforts to contain this massive fire. Since Sunday evening, every fire Department in Levy County has worked to help bring the fire under control. Our continued dry weather and little rain in addition to the heavily wooded terrain and muck ponds has made this operation very difficult .

Levy County Emergency Management hosted a meeting today with county officials and fire chiefs from Williston and Levy County Fire Rescue to discuss future options and needs to continue fighting the Badland fire. Florida Division of Forestry is utilizing as many fire teams as possible to contain the fire. Firefighters from all agencies have work 24 hours a day, starting this past Sunday afternoon, working in 12 plus hour shifts to bring the fire under control.

The Levy county Sheriff's Office and the Florida Highway Patrol are continually monitoring CR337 and SR 121 to evaluate the possible need to close the roadways do to the heavy smoke the fire is causing. We have had upwards of 32 new fires and 20,700 new acres in the state not including the 244 active fires accounting for 58,014 acres.

Many of us moved to the country rural areas to enjoy the peace and open area, but with these relocations come the chance of forest and pasture fires threatening our homes, crops, livestock, and barns. Badland Fire

BADLAND FIRE

Over 2000 acres of the Goethe Forest continues to burn out of control. The Division of Forestry has named the Levy County fire the "Badland Fire". The Division of Forestry, local Fire Departments and Fire Departments from surrounding Counties has worked around the clock fighting this fire.

On Monday, June 6, 2011 the fire spread from the west side of County Road 337 and jumped the highway on the east side of CR-337 threatening homes in the area.

Tuesday, June 7, 2011, the Badland Fire continues to be out of control resulting in the road closure of State Road 121 from Highway 19 to CR-337 and is closed to all traffic. Citizens in the south end of Levy County traveling north should use the below detour route:

From County Road 336 turn north on County Road 337. Follow CR-337 to SR-121 and turn north to Williston.

Citizens should expect delays and should travel with extreme caution due to heavy smoke in the area.

High School Students See The Harsh Reality Of Drinking & Driving

On May 25, 2011 the Levy County Sheriff's Office & the Levy County School Board sponsored, Renee Napier the founder of "The Meagan Napier Foundation". Ms. Napier spoke to Bronson High School students about her mission in life which is to share the message of the seriousness and the consequences of drinking and driving. While sharing the message, Napier also showed a short video and brought with her a trailer carrying the actual car that her daughter was in on the night she was hit by a drunk driver so the students could see.

The nightmare began on May 11, 2002 when Eric Smallridge decided to drink and drive. That decision changed the lives of many. Meagan Napier (Renee's daughter) and friend, Lisa Dickson was driving home when Smallridge struck their vehicle sending it out of control. In that moment two lives were lost and Smallridge was arrested for DUI manslaughter. Smallridge had a blood alcohol level of 0.202. Smallridge was sentenced to 22 years in the Department of Corrections.

After Napier spoke to the students, Eric Smallridge was escorted by deputies in an inmate uniform, ankle shackles and handcuffs. Smallridge talked about his life growing up and he never expected that this could happen to him. He explained to the students that this could happen to them if they choose to drink and drive.

This presentation by Napier and Smallridge was extremely touching. In 26 years of law enforcement I have never seen a more heartfelt and compelling presentation. It not only drove home the consequences of drinking and driving but also the healing power of forgiveness.

With graduation upon us, the Levy County Sheriff's Office would like to remind the students to be wise, and not drink and drive. Also remember friends do not let friends drink and drive.

The last Monday in May United States observes Memorial Day. The holiday was formerly known as Decoration Day and it commemorates U.S. Service Members who died while in the military service. The Levy County Sheriff's Office honors the men and women that have paid the ultimate sacrifice for our freedom. We pray for God to bless all of our service men/women, their families and a safe return home to our great Nation.

Otter Creek Man Arrested

On Saturday, 5/28/11, at approximately 12:58 AM, James George a family member of the recently deceased owner of Hershel's Quick Stop, in Otter Creek reported a burglary in progress. George stated to deputies that he had a bad feeling that someone might attempt to break into the store, so he remained inside the store after the business closed. George reported that he heard glass breakage three times and seen Brian Smetana running towards the business armed with a fence post. Smetana hurled the fence post through the window and George armed himself with a 44 caliber pistol. George gave a verbal warning and then fired one round not trying to hit Smetana. After the shot was fired Smetana immediately ran on foot and was later located by deputies at his residence in Otter Creek.

Smetana stated to Investigator Roger Bell that his mother used to work at the store and was let go. Smetana advised that he shot three times with a BB gun into the store. Smetana then armed himself with a fence post and through the post through the glass door. Smetana told Investigators that he was surprised that someone was inside the store and they fired a shot in his direction. Smetana stated that he had no intentions to entering the store, but was mad that his mother was terminated from the store.

Smetana was arrested for shooting into an occupied dwelling. Smetana bonded out ($15,000) of jail on May 28, 2011.

On May 29, 2011 the Levy County Sheriff's Office received a 9-1-1 call in the Cedar Key area. A mother, of a 15 year old child reported that Brian Smetana used a ladder and entered her daughter's bedroom. The complainant found Smetana naked in her daughter's bedroom and held him at gun point until deputies arrived on the scene.

The investigation revealed that the victim knew Smetana and they have been having sexual intercourse for the past two months. Smetana admitted to having sex with the 15 year old and he was arrested for lewd & lascivious sexual battery with a child.

Williston Man Arrested At Horse Hole Mud Boggs

While working the Horse Hole Mud Boggs Deputy Willie Barnes observed a white male inside the park yelling and screaming at his girlfriend. The defendant, Anthony Dale Musslewhite had been drinking all day and was very intoxicated.

Barnes advised Musslewhite to calm down several times and return to his tent. Musslewhite refused to calm down and began screaming and disturbing other citizens that were attempting to sleep.

Musslewhite was placed under arrest for disorderly intoxication and transported to the Levy County Jail.

15 Year Old Stabs a Man To Death

On May 28, 2011 deputies were working a detail at the Horse Hole Mud Boggs at 13210 SE Hwy 19 Inglis. Citizens notified the deputies and advised that a stabbing occurred in the mud pit. Within minutes deputies arrived on the scene and they identified the stabbing victim as 24 year old, Roderic L. Sparks. Emergency personnel were working on the victim and an eye witnesses advised that the person that stabbed him was in a blue Jeep. Citizens blocked the suspects with their vehicle preventing the suspect from leaving the scene.

Witnesses identified 15 year old, Christopher Sutherlin as the suspect. The investigation revealed that Christopher J Sutherlin's father was involved in verbal altercation with the victim about revving his engine. Sutherlin Sr. threw a beer can at the victim, which resulted in a physical confrontation. The victim was getting the best of the Sutherlin Sr. and his son, Sutherlin Jr., with the use of a knife stabbed the victim in the upper torso. The victim was transported to Seven Rivers hospital where he was pronounced dead.

Efforts to locate the murder weapon were unsuccessful last night. It is believed that the murder weapon was thrown in the mud pit and the Horse Hole Mud Boggs has been shut down.

On May 29, 2011 Investigators resumed the search for the murder weapon and located the knife in the mud pit.

Sutherlin Jr. was been charged with manslaughter.

Williston Man Arrested for Animal Cruelty

Time: 7:00 AM

On May 27, 2011 Deputy Clint Anderson (K-9 Deputy) responded to 550 N.E. 154^th Ave. Williston, in reference to an animal cruelty case. Upon arrival Anderson made contact with the victim, Heather Balger. Balger advised that she looked out the window and did not see her dog on his chain and the dog were missing from the back yard. The victim stated that she heard dogs barking down the street and also heard gun shots.

Balger drove to the area of the gun shots and eye witnessed Wayne Smith dragging her Pit bull across the road. Balger questioned Smith why he shot and killed her dog and he replied that the dog jumped his five foot fence and attempted to kill his animals.

During the investigation Anderson interviewed Smith and he advised that he heard a dog bark and observed a pit bull dog jump his fence and was attempting to breed his dog. Smith stated that he grabbed his 22 caliber rifle and shot the dog. During the interview Smith changed his story and stated that the dog jumped his fence and attempted to kill his goats and then attempted to breed his dog and he shot the dog. Smith gave a third conflicting statement that the dog attempted to attack him and he shot the dog and the dog ran across the road and he shot the dog between the eyes, which resulted in the dog's death.

The physical evidence at the scene did corroborate Smith's statement. Anderson arrested Smith for felony animal cruelty and he was transported to the Levy County Jail.
